1. Conclusion of a sales contract via e-mail for Autobahn Accessories:
1.1 The ordering party - a private - a company, etc. in following defined as the buyer - orders goods by e-mail from:
1.2 Autobahn Accessories ,13 Laffan St. , Hamilton , Bermuda HM09 in following called: the seller.
1.3 The parties: seller and buyer agree to accept these general terms as "part and parcel” of the sales contract - however the client (buyer) was informed about the product.
2. Order and delivery:
The client (buyer) orders the goods offered by Autobahn Accessories (seller) via e-mail. The seller starts delivery immediately after payment by credit card clearing, receipt of a check, payment in advance etc. In case of delay in delivery the seller has to inform the buyer.
2.1 In case of any defect or error the (seller) will be allowed to draw back and cancel the present sales contract. The (seller) must inform the buyer, and is obliged to pay back the money in full , less duties and shipping to the buyer.
2.2 The sales contract comes in force after payment through the buyer by credit card clearing and will be fulfilled after realization (delivery) through the seller.
2.3 The seller is not obliged to issue a " declaration of acceptance " after receipt of an order from the buyer (client). But the seller declares to inform the buyer (client) after receipt of payment about the terms of delivery, shipping note etc.
2.4 Delivery of the goods goes on risk of the buyer (client) . The buyer (client) will be charged with the transportation costs, added to the total of invoice. Any other costs on side of the buyer (client) e.g. custom fees; taxes etc. will be duty of the buyer (client).
3. Cancellation of a sales contract:
3.1 Any withdraw from a valid sales contract by the buyer (client) must be accepted in written form by the seller within 7 days from order date in order to receive 100% return. In the case the buyer (client) is not satisfied with the goods; the buyer (client) must send back the goods instantly on his/her own costs. Refunding of money will take place after receipt of the goods, checking of condition etc. as soon as possible. There will be a 25% restocking fee. There will be no returns/refunds/exchange after 30 days of the shipping/pick-up date.

4. Prices:
4.1 Currency of the prices mentioned on the homepage of the seller will be defined clearly, e.g. US-$, CDN-$ etc. If the seller offers a price or special feature of an article incorrect by mistake he will be authorized to change this by informing the buyer (client) in written form. The buyer (client) can accept the change and confirm the new conditions or cancel the present sales contract.
4.2 Prices mentioned on the homepage of seller are just valid for sales via e-commerce and do not include tax.
5. Warranty:
5.1 All products are designed for aftermarket use and are recommended for show use only. These parts are not recommended for city or highway use. The customer is responsible and assumes any liability if product is used for other than its intended purpose. Sold “AS IS”. The seller guarantees the quality and state of the goods when they are packed for shipment. The buyer is obliged to check the state of the goods after receipt and inform the seller of any defects within 3 days.
5.2 Some products may be damaged during transit. Inspect all packages immediately in the presence of the delivery person. Do not sign delivery receipt until all packages have been inspected. In the event that damage has occurred, physically write "damaged¨ on the delivery bill and have the delivery person sign it as verification. Retain all boxes and other packaging material as package may be subject to inspection by the carrier. Call Autobahn Accessories, Bermuda within 24 hours to file a claim request. Failure to comply with this policy may result in a denial for damage claim.
5.3 The seller guarantees only for the quality and attributes of the goods as far as the producer guarantees. Any other features must be defined exactly in the media used for offering (e-mail or other).
5.4 Warranty is limited to the structure of the product such as the fiberglass seam splitting, bubbling, or cracking due to natural causes. Autobahn Accessories Bermuda does not warranty products that have been modified to fit any other vehicle than the one it was designed for or if the product is painted before pre-fitting. Autobahn Accessories Bermuda does not warranty products that have been purchased used. Autobahn Accessories Bermuda does not warranty product that has been purchased from an online auction such as eBay. (Warranty is non-transferable). Any product that is painted cannot be returned. Autobahn Accessories Bermuda is not held responsible for any installation, painting, or shipping charges for a product that is returned for warranty.
5.5 There is no guarantee for parts used/damaged by the buyer (client - workshop etc.)
5.6 In case the local authorities will ask for technical test, homologation etc. this is on responsibility of the buyer.
6. Data protection:
6.1 Seller keeps knowledge of credit card information confidential. All other data is used for handling.
7. Governing law and jurisdiction:
7.1 The buyer (client) agrees to accept the laws and jurisdiction of Chamber of Commerce, Hamilton , Bermuda.Any lawsuit will be prosecuted at the Magistrates court Hamilton, Bermuda.
